There are a range of penalties for the infractions all conditioned on whether this is a first, third or more frequent offense.  What constitutes impaired may be the abuse of one or more substances which must be tested for.  The law allows for mandatory testing (you cannot refuse to be tested) under implied consent.  So once you have been arrested you should have a law firm experienced with drunk driving litigation.
